Antitrust Statement

Professional Associations, such as HL7, which bring together competing entities are subject to strict 
scrutiny under applicable antitrust laws. HL7 recognizes that the antitrust laws were enacted to promote 
fairness in competition and, as such, supports laws against monopoly and restraints of trade and their 
enforcement. Each individual participating in HL7 meetings and conferences, regardless of venue, is 
responsible for knowing the contents of and adhering to the HL7 Antitrust Policy as stated in §05.01 of 
the Governance and Operations Manual (GOM).

Yan Heras - gave an update on Da Vinci Value-Based Contract Reporting project.

With the shift from fee for service to value-based care, Value-Based Contracts have emerged as a mechanism that payers may use to better align their contracting structures with broader changes in the health care system. This implementation guide specifies standard format for value based performance reports and mechanisms for exchanging standardized value based performance reports between providers and payers for value based quality and risk contracts.

Should it be considered by the Payer and Provider members of PIE, and their respective allied vendors.  The might apply to those who might have an interest in health equity related project, for which FHIR and collecting SOGI data, as with Race/Ethnicity and Language on consumers/members/patients it will be important.

Summary: Use of both Patient and Observation Resource to capture "Personal Characteristic" for Gender Identity, Recorded Sex or Gender, Pronouns etc.

Description:

While initially there where thoughts that a single Resource should be used to collect details of ones Gender Identity, Recorded Sex or Gender, and Pronouns, there are reasons/use cases that would support the use of both the Patient Resource and Observation Resource. 

The use of the Observation Resource would support providing the source and method for the collection of personal characteristics (i.e. Gender Identity, Recorded Sex or Gender, Pronouns) over multiple encounters that may change over time.  While the need for an institution to have a single instance to identify Gender Identity, Recorded Sex or Gender, and Pronouns would support the use of the Patient Resource to contain the data.

For these reasons, I recommend both the use of the Social Determinants of Health IG proposed Personal Characteristic Observation as well as the Patient Resource.
