Antitrust Statement

Professional Associations, such as HL7, which bring together competing entities are subject to strict 
scrutiny under applicable antitrust laws. HL7 recognizes that the antitrust laws were enacted to promote 
fairness in competition and, as such, supports laws against monopoly and restraints of trade and their 
enforcement. Each individual participating in HL7 meetings and conferences, regardless of venue, is 
responsible for knowing the contents of and adhering to the HL7 Antitrust Policy as stated in §05.01 of 
the Governance and Operations Manual (GOM).

PSS-2101  Lab Orders - Commented that the PIE WG reviewed and not an interested party at this time.

PSS-2111  Da Vinci Value-based Contract Reporting - Mark S. stated that during review on the FM call, there were not enough co-chairs or resources to sponsor the PSS at this time. PIE WG is interested and may want to co-sponsor for this project.  Commented that we need a deeper dive with the project team.  Can we ask to have a meeting to review this in detail and obligations?  We can add you to our next WG meeting on 08/16/22.

  1. NCVHS July 20-21 Full Committee Meeting updates

Key topics included:

  • Current Issues in Cybersecurity;
  • Legislative Developments on Data Privacy;
  • SOGI and SDOH Data Measures, Collection and Use;
  • Tribal Data Access and Privacy; 
  • Standards Subcommittee Proposed Recommendations; and 
  • Standards Subcommittee updates on New HIPAA Transaction Standards and Operating Rules requests, and ICD-11 Developments.  

Proposed recommendations presented by Standards Subcommittee were direct follow-up to June Listening Session where HL7 and Da Vinci, and others from industry, provided input on specific consideration areas.  Four proposed recommendations received support and will be sent to Secretary Becerra (HHS). (final letter will be posted soon)

NCVHS plans are taking shape to receive industry testimony on requested consideration of new national standards. This includes:

  • X12's Claims (837 I, P, D) and Remittance Advice(835) 8020 Implementation Guides (upgrade select 5010 standards)
  • CAQH CORE's Infrastructure, Data Content Operating Rules, and Connectivity Rule. (upgrade rules and add new rules)

Infrastructure rules for Eligibility, Claims Status and ERA Operating Rules; Data Content Rules for Eligibility & Benefits Operating Rule; Connectivity Rule;

New Attachments Operating Rule; New Eligibility & Benefits Single Patient Attribution Data Content Rule

One-day listening sessions are likely for each - meaning 2 days worth of industry input will inform the recommendations advanced to HHS/CMS National Standards Group. Timing could be as early as September. HL7 will participate and will develop response based on input of Work Groups and Accelerators.

Alix summarized the meeting.  Asked Durwin what the process is to have HIPAA/CAQH CORE IGs reviewed by the industry for the 835 and 837 guides.

Possible FHIR mappings and critical proposed rules may come out this Fall.  Mike D. pointed out that a CAQH CORE Attachments rule could come before a guide.

Attachment NPRM pushed out until December 2023 or sooner.
